These terms of sale set out how the Bimo Premium offer is purchased, paid for, renewed and cancelled within the Bimo app published by BAUGEY MATHEO (DEVOLIM). They supplement the terms of use and are addressed to consumers within the meaning of the French Consumer Code.

This English version is provided for convenience. In the event of any discrepancy, the French version prevails.

1. Plans offered

Premium Monthly: automatically renewing month by month, with no free trial.

Premium Yearly: automatically renewing year by year, preceded, where applicable, by a free trial period (Article 6).

No “lifetime” purchase is offered. Both plans give access to the same features. The Publisher may occasionally run promotional offers or different trial lengths; the terms that apply are then those shown in the app at the time of purchase.

2. What Premium includes

Premium removes the counters. It gives you:

  • unlimited checks, whatever their nature: a message, an email, a link, a phone number, an IBAN or a screenshot: a check is a check;
  • several trusted people around you, beyond the first one, which stays free;
  • unlimited advice requests to those people;
  • automatic alerts: your trusted people are warned when a check concludes that something is a clear scam, optional, and only if both people in the link have agreed to it.

Free, with or without a subscription:

  • helping someone: answering a relative's advice requests, receiving their alerts, standing by them, with no limit and no subscription. Whoever helps never pays;
  • a first trusted person;
  • the educational guides and the history, which stays on your phone.

Asking a relative for advice uses one peanut, like any other check. It is a request for a human read: it comes out of the same reserve, with no separate free quota.

Helping is free; checking is counted. These are two different things. You may support as many relatives as you wish without paying anything, but your own checks use up your peanuts (section 3), whether you help someone or not.

The subscription gives access to a service, not to a guaranteed volume: reasonable anti-abuse caps, intended to exclude automated or manifestly disproportionate use, apply to the unlimited plans. They do not affect normal personal use.

3. Peanuts (check units)

Without a subscription, each check uses one peanut. The kind of content does not matter: a message, a link on its own, a phone number, an IBAN or a screenshot each cost one peanut.

On installation: 5 peanuts, free.

Every week: 1 peanut back.

The weekly reserve is capped at 5: a long absence does not pile them up beyond that.

Peanuts earned or given (section 4) are added on top of that cap.

Two allowances apply on their own, without you having to ask:

  • the back-and-forth of a single check (clarifying a message, adding the link that was missing, asking again) counts as one peanut only, within a reasonable limit and for twenty-four hours;
  • content that has already been analysed recently, by you or by someone else, costs nothing: the verdict is served again.

Peanuts have no monetary value. They cannot be bought, sold, transferred between accounts, converted, or refunded. They are neither a currency, nor a payment instrument, nor a credit balance. They disappear with the account.

These figures may change; the ones that apply are always shown in the app. A daily cap on checks also applies to every account, subscribers included, to exclude automated use; it has no effect on normal personal use.

4. Referrals

The app offers a referral code. When someone you invited enters your code and then actually completes a first check, you each receive the same number of peanuts, as shown in the app. The number of rewarded referrals is capped per account.

  • The reward requires a genuinely new account: an account that has already been used can no longer be referred.
  • Peanuts earned follow section 3 in every respect: no monetary value, no refund, no conversion.
  • The Publisher may refuse or take back a reward in the event of obvious circumvention, in particular the creation of accounts in series to manufacture peanuts.
  • Referrals may be changed or suspended at any time; peanuts already credited remain yours.

5. Price, currency and tax

The exact price is shown in the app before you subscribe, and again by the distribution platform at the confirmation step. It is set and charged by the App Store or the Google Play Store, expressed in your local currency according to that platform's price grid and your billing country. The final amount, including any taxes, is the one the platform displays before you confirm.

Under Article 293 B of the French General Tax Code: VAT not applicable. Where the platform acts as the person liable for tax in the User's country, the amounts applied are those it displays.

6. Free trial

The yearly plan may begin with a free trial period, whose length is shown in the app before you subscribe. During the trial, all Premium features are available with no charge.

At the end of the trial the yearly subscription continues automatically and your Apple or Google account is charged the current price, unless it is cancelled before the trial ends: at least twenty-four (24) hours before on the App Store, any time before it ends on Google Play. The trial is reserved for people who have not already used it and can be used only once per platform account. Cancelling during the trial is free of charge, and Premium access is kept until the end of the trial period.

Whether a trial exists, and how long it lasts, varies by plan, by period and by country; only what the app shows at the time of purchase is authoritative.

7. Payment

Payment is made exclusively through the Apple or Google account associated with the device, depending on where the app was downloaded. The Publisher collects and stores no payment data and receives neither your identity nor your billing address. Purchase validation is handled by the provider RevenueCat, as described in the privacy policy.

The purchase receipt is issued by the platform concerned, which alone can produce the corresponding invoice.

8. Automatic renewal

The monthly and yearly subscriptions renew automatically: your Apple or Google account is charged the current price at each renewal date, unless cancelled before the end of the current period: at least twenty-four (24) hours before on the App Store, any time before the renewal date on Google Play, in accordance with each platform's rules.

Under Articles L.215-1 et seq. of the French Consumer Code, the User may cancel at any time, without charge or penalty, with effect at the end of the current period. Information about the right not to renew is provided by the distribution platform, which manages the billing schedule.

9. Cancellation

Cancellation is done from the store account that recorded the purchase:

Cancellation takes effect at the end of the period already paid for: Premium features remain available until then, with no further charge. Uninstalling the app does not cancel the subscription.

10. Restoring purchases

If you reinstall the app or change device, the subscription can be restored from the subscription screen using “Restore purchases”, provided you are signed in with the same Apple or Google account used for the purchase. A purchase made on the App Store cannot, because the platforms are separate, be restored on an Android device, and vice versa.

Note that restoring covers the subscription only: the app's anonymous identifier, and with it the trusted links, may not be recovered after a reinstall or the loss of the device (Article 8 of the terms of use).

11. Right of withdrawal: express waiver

Under Article L.221-28, 13° of the French Consumer Code, the fourteen-day right of withdrawal cannot be exercised for digital content not supplied on a tangible medium where performance has begun with the consumer's prior express consent and express waiver of that right.

By subscribing to Bimo Premium, you expressly request immediate supply of the digital content and expressly waive your right of withdrawal as soon as the features are unlocked. This waiver does not affect your ability to cancel at any time (Article 9) or the statutory guarantees set out in Article 14 of the terms of use.

Where the purchase is preceded by a free trial, no amount is charged before the trial ends: cancelling during the trial remains possible at any time and free of charge.

12. Refunds

As purchases are collected by the platforms, refund requests fall exclusively under their respective policies:

The Publisher has no technical ability to issue a refund itself, but can help you with the process. This limitation does not affect the statutory guarantees, which may be invoked directly against the Publisher, nor the pro rata refund provided for in Article 17 of the terms of use in the event of unjustified suspension.

13. Changes to prices and to the offer

The Publisher may change its prices for future subscription periods. Any change affecting a current subscription is notified by Apple or Google, within the timeframes and in the manner they provide for; if it is not accepted, the subscription ends at the end of the current period, free of charge.

The content of the Premium offer may evolve, in particular through the addition of features. Should a substantial feature be removed during a subscription without an equivalent replacement, the User may cancel and obtain a refund pro rata for the unused period, in accordance with Article L.224-25-27 of the French Consumer Code and the remedies set out in Articles L.224-25-12 et seq. of that code.

14. End of the subscription

When the subscription expires, the app returns to its free tier: every kind of check stays available, but each one is counted in peanuts again (section 3). Trusted links already established remain; only trusted people beyond the first and automatic alerts stop being available. The history held on the device is unaffected.

Should the service be discontinued permanently, the Publisher would inform users within a reasonable time and stop renewals; consumers' statutory rights, in particular the guarantee of conformity for digital content, remain applicable in all cases.

15. Complaints and governing law

Any complaint about a subscription may be addressed to [email protected]. The Publisher answers directly and works towards an amicable solution.

The sale of the subscription is not concluded with the Publisher. The subscription is sold by the distribution platform, Apple (App Store) or Google (Google Play), which collects the price, issues the invoice and alone handles refund requests (section 12). The Publisher supplies the service so purchased. Complaints about the sale, the charge, the invoice or a refund therefore fall to the platform concerned and to its own channels, set out in section 12.

For everything relating to the supply of the service by the Publisher, consumers keep all of their rights, including the right to bring proceedings before the court of their choice, and are deprived of no remedy by these terms.

These terms are governed by French law, without prejudice to the mandatory consumer protection rules applicable in the consumer's country of residence.
